1. Scope
These Terms of Service govern the use of the Moduvation learning platform (moduvation.com), operated by [YOUR FULL NAME], [YOUR ADDRESS], email: [YOUR CONTACT EMAIL] ("we", "Moduvation").
2. Description of Service
Moduvation is a learning platform with roles for teachers, students, and parents. At its core is vocabulary training based on the Leitner method (a flashcard system with spaced repetition intervals). Teachers can link students to themselves via referral codes, assign words, and view their progress. Teachers may optionally connect their Google Drive account to share teaching material with linked students.
3. Registration and Accounts
Using the service requires an account. Information provided at registration must be accurate. Login credentials must be kept confidential and not shared with third parties. For student accounts belonging to minors, we assume consent from a parent/guardian, or use within a school-supervised context (see Privacy Policy, section 5).
4. User Obligations
Users agree not to misuse the platform — in particular, no automated access outside the intended features, no sharing of someone else's login credentials, and no uploading or sharing of content that violates applicable law.
5. Google Drive Connection
Connecting a Google Drive account is a voluntary add-on feature for teachers. By connecting, the teacher allows Moduvation to access a folder they choose in their own Google Drive (reading and adding files). The connection can be disconnected at any time from the account settings; details on data processing are in the Privacy Policy.
6. Availability
Moduvation is under active development. We aim for stable operation but cannot guarantee uninterrupted availability. Maintenance, outages, or ongoing development may cause temporary limitations.
7. Liability
We are liable without limitation for intent and gross negligence, and as required by applicable product liability law. For ordinary negligence, we are liable only for breach of material contractual obligations, and limited to foreseeable, typical damages. Liability is otherwise excluded, to the extent permitted by law.
8. Termination and Suspension
Users may request deletion of their account at any time (contact the address below). We reserve the right to suspend or delete accounts that violate these terms.
9. Changes to These Terms
We may update these terms, for example when introducing new features or in response to legal changes. We will inform registered users of material changes in an appropriate manner.
10. Governing Law
These terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods. If the user is a consumer, mandatory consumer protection provisions of their place of habitual residence remain unaffected.
